Appellate court rules on city's Medicare Advantage plan

A New York State appellate court has found that the city has made "clear, consistent, unambiguous representations … that New York City municipal worker-retirees would have the option of receiving health care in the form of traditional Medicare with a City-paid supplemental plan." While the court held that implementing a Medicare Advantage Plan without a supplemental plan option was lawful, because of the promise, the option could not be taken away from retirees.
The UFT is not a party to these cases. The city has indicated its intent to further appeal the recent decision.
The UFT continues to fight vigorously to protect and preserve premium-free, high-quality health care for both in-service and retired members.
